The Sky Ranch Community Authority Board (the “Authority”) is a public corporation and political subdivision of the State of Colorado, created by the Second Amended Sky Ranch Community Authority Board Establishment Agreement dated August 13, 2021, by and between the Sky Ranch Metropolitan District No. 1 (“District No. 1”), Sky Ranch Metropolitan District No. 3 (“District No. 3”), and Sky Ranch Metropolitan District No. 5 (”District No. 5”), as it may be amended from time to time (the “Establishment Agreement”), under Sections 29-1-203 and -203.5, C.R.S. 

The Authority has been established for the purpose of financing and installing street, park and recreation, water, sanitation, transportation, mosquito control, safety protection, and television relay and translation improvements with the service area of the Districts and the provision of covenant enforcement, design review, and security services; and all other improvements or services permitted by Article 1, Title 32, C.R.S. and the Establishment Agreement (collectively, the “Public Improvements and Services”), except as specifically limited by the Modified Service Plan for District No. 1 approved by the Board of County Commissioners of Aurora County on September 14, 2004, and the Amended and Restated Service Plans for District No. 3 and District No. 5 approved by the Board of County Commissioners of Aurora County on December 8, 2020, as may be amended from time to time (the “Service Plan” or the “Service Plans”) and the Establishment Agreement. 

The Public Improvements and Services are for the use and benefit of the residents and taxpayers within the service area of the Authority and the Districts.  The Authority is located in Arapahoe County, Colorado.

The Authority may issue debt, but is limited to the same amount of debt that the Districts, collectively, may issue.  The Authority may incur a maximum debt of $312,000,000.  Ad valorem property taxes, specific ownership taxes, and fees may be used to repay the debt.

The Authority does not impose a debt service mill levy, but District No. 1 may assess a maximum mill levy, as adjusted after September 14, 2004, of fifty (50) mills to repay debt issued by the Authority.  District No. 3 and District No. 5 may assess a maximum mill levy, as adjusted after January 1, 2020, of 55.664 mills to repay debt issued by the Authority.  The Districts may assess an operations and maintenance mill levy.

The Authority must file an Annual Report to the Arapahoe County Clerk and Recorder.

The Authority does not have boundaries, but the District’s boundaries overlap with the boundaries of:  Arapahoe County, Arapahoe County L.E.A, Arapahoe Library District, Developmental Disability, Bennett Fire Protection, Regional Transportation District (“RTD”), Urban Drainage and Flood Control District, and the Urban Drainage and Flood Control District South Platte; District No. 1 overlaps with Adams-Arapahoe School District 28J (Aurora Public Schools), and Districts No. 3 and District No. 5 overlap with Bennett School District #29

Sky Ranch Metropolitan District No. 1 (the “District”) is a Title 32 Special District that has been established for the purpose of financing and installing street, park and recreation, water, sanitation, transportation, mosquito control, safety protection, and television relay and translation improvements of the District, and the provision of covenant enforcement, design review, and security services; and all other improvements or services permitted by Article 1, Title 32, C.R.S. (collectively, the “Public Improvements and Services”), except as specifically limited by the Modified Service Plan for the District, approved by the Board of County Commissioners of Arapahoe County on September 14, 2004, as it may be amended from time to time (the “Service Plan”)

The District is a party to the Second Amended Sky Ranch Community Authority Board Establishment Agreement dated August 13, 2021, by and between the District, Sky Ranch Metropolitan District No. 3 (“District No. 3”), and Sky Ranch Metropolitan District No. 5 (”District No. 5”), as it may be amended from time to time (the “Establishment Agreement”), which created the Sky Ranch Community Authority Board (the “Authority”), a public corporation and political subdivision of the State of Colorado under Sections 29-1-203 and -203.5, C.R.S.

The Authority provides the Public Improvements and Services for the use and benefit of the residents and taxpayers of the District.  The District is located in Arapahoe County, Colorado. The District is a quasi-municipal political subdivision of the State of Colorado authorized to provide specialized services that Arapahoe County does not provide.

The District may incur a maximum debt of $162,000,000, which has been pledged to the Authority under the Establishment Agreement for the repayment of the Authority’s debt.  Ad valorem property taxes, specific ownership taxes, and any other legally available moneys including but not limited to fees, rates, tolls, penalties, or charge may be used to repay such debt. 

The District may assess a maximum debt mill levy of fifty (50) mills, as adjusted on or after September 14, 2004, to repay debt, including debt issued by the Authority.

The District must file an Annual Report to the Arapahoe County Clerk and Recorder.

The District’s boundaries overlap with the boundaries of:  Aurora School District #28J, Arapahoe County, Arapahoe County L.E.A., Developmental Disability, Arapahoe Library District, Bennett Fire Protection, Regional Transportation District (“RTD”), Urban Drainage and Flood Control District, and the Urban Drainage and Flood Control District South Platte.
